Reflectra Care — Terms of Service

Status: DRAFT. This first draft is engineering's plain-language description of the agreement between the user and Reflectra. Counsel must review and finalize before public release. Do not link from app stores until sign-off.

1. Acceptance

By installing or using Reflectra Care ("the app"), you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

You must be at least 17 years old to use Reflectra Care. If you are a clinician, you also represent that you are licensed to practice in your jurisdiction.

2. What Reflectra Care is — and what it is not

Reflectra Care is a mental-health support tool. It helps you:

  • Capture voice diary entries
  • Track mood and biometrics
  • Share that information with a clinician you choose

Reflectra Care is NOT:

  • A medical device
  • A substitute for professional diagnosis or treatment
  • A crisis or emergency service

If you are in immediate danger, please call your local emergency number (US: 911, EU: 112) or a crisis line (US: 988 Suicide & Crisis Lifeline) right now. Reflectra Care will surface high-severity risk events to your clinician, but does not call emergency services on your behalf in v1.

3. Your account

  • You are responsible for keeping your account credentials secure.
  • You may not share your account with anyone else.
  • You are responsible for the accuracy of the information you provide.
  • We may suspend or close accounts that violate these Terms or are inactive for more than 24 months.

4. Acceptable use

You agree not to:

  • Use the app to harass, threaten, or harm any other person.
  • Upload content that is unlawful, infringing, or harmful.
  • Reverse-engineer, decompile, or attempt to extract source code from the app.
  • Probe or test the security of our backend without prior written permission.
  • Use the app to provide medical advice to others if you are not a licensed clinician.
  • Use automated tools or bots to interact with the app.

5. Voice recording and consent

You agree that:

  • You are responsible for recording only conversations where local law allows it. The app's recording-consent helper is a guideline, not legal advice.
  • If you record another person, you must comply with all applicable one-party-consent or two-party-consent laws in your jurisdiction.
  • You will not record minors without a guardian's consent.
  • We retain a record of every consent decision you make in-app for compliance audit purposes.

6. Clinical relationship

Reflectra Care does not create a clinician-patient relationship between you and Reflectra. Your clinician relationship is separately established with the licensed professional you assign in the app.

Clinicians who use Reflectra Care to view assigned patients agree to:

  • Verify each patient's identity before relying on data shown in the app.
  • Document clinical decisions in their primary medical record system; the app is a supplemental view, not the medical record of record.
  • Comply with all applicable laws and professional standards for the patients in their care.

7. AI features

The app uses third-party AI providers (Anthropic, OpenAI, ElevenLabs) to:

  • Transcribe your voice
  • Summarize your sessions and weekly trends
  • Score the risk severity of your transcripts

You acknowledge that:

  • AI output is advisory only and may be inaccurate.
  • A clinician — not the AI — makes every clinical decision.
  • We do not use your conversations to train any AI model.

8. Subscription, billing, and free use

The beta program is free. If we introduce paid plans, you will be told in-app at least 30 days in advance and given the option to cancel before any charge.

9. Intellectual property

  • The app, its design, and its source code are owned by Reflectra and its licensors.
  • Your data — diary entries, voice recordings, mood, biometrics — belongs to you. You grant us a limited license to store, process, and display it only to provide the service to you and your assigned clinician.

10. Termination

You may stop using the app at any time. You may delete your account from Patient Settings at any time, with no questions asked.

We may suspend or terminate your account if you violate these Terms, with at least 14 days' notice except when immediate suspension is required to protect other users or comply with law.

11. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The app will be uninterrupted or error-free.
  • Any defects will be corrected.
  • The app will meet your specific requirements.
  • The AI-generated summaries will be accurate or complete.

12. Limitation of liability

To the maximum extent permitted by law, Reflectra and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

(a) Your use of, or inability to use, the app (b) Any conduct or content of any third party on the app (c) Unauthorized access, use, or alteration of your transmissions or content (d) AI-generated content that you or your clinician acted upon

In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, our liability is limited to the maximum extent permitted by law.

13. Governing law

These Terms are governed by the laws of TBD (Reflectra's primary jurisdiction of operation), without regard to conflict-of-laws principles. Any dispute arising out of these Terms will be resolved in the courts of TBD.

If you are a consumer in the European Union, you may also bring a claim in the courts of the EU member state where you reside.

14. Changes to these Terms

We will notify you in-app at least 14 days before any material change takes effect. Continued use after the effective date constitutes acceptance.
